I have been in an automobile accident. What should I do now?

You may very well be worried about your automobile and the effect on your car insurance, but the most important thing you can do is ensure that you and your family are safe and receive prompt medical attention if it is needed. After attending to health and safety issues, there are other steps you can take to protect your legal and monetary interests as well, including the following:

Exchange insurance information with the other driver. Make sure you get their name and their insurance provider.
If there were witnesses to the incident, try to obtain their contact information.

If possible, take pictures of both vehicles from multiple angles, including the inside and outside of the car. Take pictures of the accident scene as well, so as to document skid marks or other property damage. If you have suffered injuries, you should take pictures of those as well.

Lastly, contact an attorney as soon as possible. Your attorney may choose to send an investigator to the scene of the accident. Also, do not take your vehicle to a repair shop until you have spoken to your attorney. Do not provide any kind of written statement or sign anything from an insurance company until you have spoken to your lawyer.

What happens if the other driver doesn't have insurance?

It depends. Check your own insurance policy to see if you are carrying Uninsured Motorist/Underinsured Motorist (UM/UIM) coverage. You should have this coverage unless you specifically declined it when purchasing your liability policy. If covered, you will have at least $25,000 worth of coverage for your personal injuries.

I think I may have partially been at fault in the accident. Can I still bring a claim?
